Colorado ‘KitchenAid Mixer Crew’ argues for lesser charge because stolen goods were on sale

https://www.yahoo.com/news/colorado-kitchenaid-mixer-crew-argues-002925457.html

During the trial, the defense attorneys told members of the jury that Green and Bolden should face a lesser misdemeanor charge since some of the items they stole were "on sale" at the time of the theft. More liberal logic on display.

Under Colorado law, theft less than $2,000 is a misdemeanor offense, while theft between $2,000 and $5,000 is a felony — prosecutors valued the items stolen by the duo at just under $2,095. Apparently suck at math as well

"Just because an item is ‘on sale’ doesn’t mean it’s free to steal, and these defendants now get to think about this lesson in jail and prison," District Attorney John Kellner said. Thankfully at least one person in Colorado still retains common sense.

Were there similar items not on sale? Maybe the thieves engaged in "stucturing" to keep the value under the felony limit.

How about, "Sale prices are only for customers that actually buy the items"?

Analogy: "We should reduce the rape charges because she was already at a pick-up bar and was expecting to have sex with someone..."

Well, if the pair stole $2,095 worth of items, that is ONLY $1,047.50 each. Why didn't the defense attorney think of that argument?

I'm actually surprised anyone was arrested and that there is actually a trial.
Ca was under 1000 so Colorado upped the ante and made it 2k? So you can walk into a bank and tell the teller to give you 1995 and it's only a misdemeanor?

If we bring back public hangings for theft, theft would probably decrease.
