WASHINGTON (AP) — Oath Keepers founder Stewart Rhodes was convicted Tuesday of seditious conspiracy for a violent plot to overturn Democrat Joe Biden’s presidential win, handing the Justice Department a major victory in its massive prosecution of the Jan. 6, 2021, insurrection.

A Washington, D.C., jury found Rhodes guilty of sedition after three days of deliberations in the nearly two-month-long trial that showcased the far-right extremist group’s efforts to keep Republican Donald Trump in the White House at all costs.

Using dozens of encrypted messages, recordings and surveillance video, prosecutors made the case that Rhodes began shortly after the 2020 election to prepare an armed rebellion to stop the transfer of presidential power.

The son of militia leader Stewart Rhodes spent years plotting to help his family escape from his father's control. Now that the elder Rhodes faces decades in prison, the rest of the family is rebuilding their lives.

The time had come. It was a dreary February day in 2018. Dakota had it all planned out.

His mother and five younger siblings were in the truck - some of them crouched out of sight on the floor.

They'd bundled into it as much as they could and made up an excuse - ostensibly they were heading to the trash dump just off the main highway, slick with black ice and crusted snow.

A jury in the United States has convicted four members of the far-right Oath Keepers of seditious conspiracy over their roles in the US Capitol riot, as authorities continue to prosecute individuals accused of plotting to keep former President Donald Trump in power.

The 12-member jury found Oath Keepers David Moerschel, Joseph Hackett, Roberto Minuta and Edward Vallejo guilty of seditious conspiracy on Monday. All four members also were found guilty of various obstruction and felony charges.

Prosecutors said in court papers filed Friday that Rhodes "exploited his vast public influence" as leader of the right-wing militia group to persuade others to attack the Capitol to stop the peaceful transfer of power from then-President Donald Trump to Joe Biden.

"(Rhodes) used his talents for manipulation to goad more than twenty other American citizens into using force, intimidation, and violence to seek to impose their preferred result on a U.S. presidential election," the filing reads. "This conduct created a grave risk to our democratic system of government and must be met with swift and severe punishment."

WASHINGTON (AP) — Oath Keepers founder Stewart Rhodes and members of his antigovernment group will be the first Jan. 6 defendants sentenced for seditious conspiracy in a series of hearings beginning this week that will set the standard for more punishments of far-right extremists to follow.

Prosecutors will urge the judge on Thursday to put Rhodes behind bars for 25 years, which would be the harshest sentence by far handed down in the deadly U.S. Capitol attack. Describing the Oath Keepers' actions as “terrorism," the Justice Department says stiff punishments are crucial to send a message to future possible instigators of political violence.

Stewart Rhodes, founder of the right-wing militia group Oath Keepers, was sentenced to 18 years in prison and 3 years of supervised release Thursday after being convicted of seditious conspiracy in connection with the Jan. 6, 2021 Capitol attack. It's the first sentence passed down to a person found guilty of the rare, Civil War-era charge linked to the riot.

Sporting an orange jumpsuit and his signature eyepatch under wire frame glasses, Rhodes brazenly addressed the court before the sentence was handed down, calling himself a "political prisoner" with "preordained guilt from Day One."

"However long I spend in prison, my goal will be to be an American Solzhenitsyn to expose the criminality of this regime," Rhodes said, comparing himself to prominent Soviet dissident Aleksandr Solzhenitsyn and referencing the Biden administration.

Former Oath Keeper sentenced for role in Jan. 6 Capitol attack​

A former leading member of the far-right Oath Keepers militia group was sentenced Friday to eight years and six months in prison for her role in the Jan. 6 attack on the Capitol.

Jessica Watkins led a small group into the Capitol building, but prosecutors said her actions enabled many more to ultimately disrupt the certification of Joe Biden's 2020 election victory.

Struggling to express her remorse through her tears, Watkins apologized before the court.

"My actions and behaviors on that fateful day were wrong and -- as I now understand -- criminal," she said.

Oath Keeper who guarded Roger Stone before Jan. 6 attack gets more than 4 years in prison​

WASHINGTON (AP) — A member of the far-right Oath Keepers extremist group who was part of a security detail for former President Donald Trump 's longtime adviser Roger Stone before storming the U.S. Capitol was sentenced on Thursday to more than four years in prison.

Roberto Minuta, who was seen on video guarding Stone hours before the riot on Jan. 6, 2021, was among six Oath Keeper members convicted by jurors of seditious conspiracy for what prosecutors said was a violent plot to stop the transfer of power from Trump to President Joe Biden after the 2020 election.

Hackett, a Florida chiropractor and low-level Oath Keepers leader, was sentenced to 42 months in prison while Moerschel received a three-year prison term.

The sentences were both significantly lower than prosecutors' recommendations of 12 years for Hackett and 10 years for Moerschel.

Supreme Court Gives Prosecutors Ammo in Oath Keepers Capitol Riot Case​

The Supreme Court recently discussed the use of acquitted charges in sentencing hearings, possibly giving prosecutors in the Oath Keepers trial ammo for the sentencing of two defendants.

On Tuesday, Roger Parloff, a senior editor at Lawfare, shared a Twitter thread discussing a recent opinion by the Supreme Court. "The statements relate to the practice of holding conduct against a defendant at sentencing even though the jury acquitted the defendant of that conduct," Parloff wrote.

Parloff went on to discuss how this could impact the sentencing for two members of the Oath Keepers, Thomas Caldwell and Michael Greene. "This issue most dramatically affects def Tom Caldwell, who was acquitted of all conspiracies in the OK seditious conspiracy case. Nevertheless, govt originally sought a 14-yr sentence for him based largely on his conspiratorial acts relating to the 'quick reaction forces,'" Parloff wrote.

The Justice Department on Wednesday appealed the sentences handed down to seven members of the Oath Keepers — including founder Stewart Rhodes — for their roles in the Jan. 6 attack on the Capitol, a signal that prosecutors are not satisfied with the severity of the jail terms delivered by the federal judge overseeing the case.

U.S. District Court Judge Amit Mehta sentenced Rhodes to 18 years in prison — the harshest sentence for any Jan. 6 defendant — reflecting his leadership of what Mehta characterized as a dangerous criminal conspiracy aimed at violently derailing the transfer of presidential power.

Nevertheless, the sentence for the Yale Law School graduate and disbarred attorney was seven years shorter than the 25-year prison term prosecutors recommended and four years below an agreed-upon “guidelines range” based upon Rhodes’ conduct.

Donovan Ray Crowl, one of the first rioters to be identified in national news media as part of a line of Oath Keepers who marched single-file in combat-style gear on the Capitol steps on Jan. 6, 2021, was convicted Wednesday by a federal judge of conspiracy to obstruct the electoral college vote count and civil disorder.

But a second man charged with Crowl, James D. Beeks, a stage actor and Michael Jackson impersonator from Florida, was acquitted of the same two counts, becoming the first Oath Keeper to be cleared of all Jan. 6-related charges. Beeks had not met or spoken with any of the Oath Keepers before connecting with them at the Ellipse that morning, and U.S. District Judge Amit P. Mehta found no evidence that he was aware of any plan to disrupt the transfer of presidential power to Joe Biden.
