Jury selection begins in trial for Proud Boys leaders charged with seditious conspiracy​

The nation's case against the extremist Proud Boys group is set to heat up Monday, when jury selection is scheduled to begin for the group's former national chairman and its four top associates in connection to the deadly Jan. 6, 2021, Capitol attack.

Leader Henry "Enrique" Tarrio, 38; along with Ethan Nordean, 31; Joseph Biggs, 38; Zachary Rehl, 37; and Dominic Pezzola, 44, face nine charges including seditious conspiracy stand in an organized plot to prevent the certification of President Joe Biden's election.

what the law does to these Boys will set a precedent for future patriots

there is a good chance in my book that the corrupt judicial system will make an example of these fellows to send a message to anyone else who messes with them

Opening statements are underway in the trial of longtime Proud Boys Chairman Henry “Enrique” Tarrio and four other associates of the right-wing group charged with seditious conspiracy in the Jan. 6, 2021, Capitol riot.

Two years after the attack, the trial is one of the most high profile of the sprawling investigation into the day’s events. It comes more than a month after federal prosecutors secured a seditious conspiracy conviction against Oath Keepers founder Stewart Rhodes and a top deputy. A jury found Rhodes guilty of leading a months-long plot to unleash political violence to prevent the inauguration of President Biden that ended with the Jan. 6 attack.

Of the more than 900 defendants who have been charged for their actions on Jan. 6, 2021, 44 have elected to take their case to trial so far, not including the current Proud Boys trial. Of that group, all but one have been convicted, and the sentences handed down so far have been roughly 21 months longer than for those who have pleaded guilty to felonies, according to a Washington Post analysis.

As of Jan. 2, there had been 39 felony trials and five misdemeanor trials. Defendants have been convicted in all 39 felony cases, with the acquittal coming in a misdemeanor bench trial. Twenty of the trials have been in front of a jury, and the government is 20-0.

You just need one juror for an acquittal, right? Somewhere between 120 and 240 jurors (not sure if the juries were 6 or 12 people) have voted to convict someone already.

Tarrio and other Proud Boys who believed they were acting on Trump's wishes when they stormed the U.S. Capitol on Jan. 6, 2021, are merely "scapegoats" for the government, he continued, because it would be too hard to put the ex-president on the witness stand, "with his army of lawyers."

 
Hope this is true and hope they actually do it. Could get real interesting.

 
Nice try FIB, that won't get you anywhere

In a lot of the trials that already happened you had defense lawyers, prosecutors and a few judges blaming Jan 6 directly on T. But no one, as of yet, has subpoenaed him.

As for T, all he has really done was to praise the rioters on social media. Be really interesting to see him in a court room where he'd be called to testify that he either wanted them to assault the capital or that he didn't tell them to do it.

I can assure you that he wouldn't say anything that would even remotely make it look like he wanted an insurrection. My bet would be he'd disavow everything that happened and say the peeps are getting what they deserve. He'd be a fool not to.

All this said................pretty sure that the vast majority of those involved feel like they were played for fools.

That's about the flimsiest excuse for taking action ever! Trump also clearly said "Peacefully protest" but apparently that didn't register....

As Donald Trump fought for his political life in the fall of 2020 — and then attempted to subvert an election he lost — the Proud Boys confronted an identity crisis, fueled at every turn by Trump’s words and actions.

In private messages, revealed Thursday by prosecutors at a seditious conspiracy trial stemming from the Jan. 6 attack on the Capitol, members of the group discussed Trump’s Sept. 29 debate-stage exhortation to the Proud Boys to “stand back and stand by” ahead of the November election.

(Reuters) - A former member of the far-right Proud Boys told a jury on Wednesday that the group was “desperate” to stop former President Donald Trump’s defeat in the 2020 election and viewed the Jan. 6, 2021 attack on the U.S. Capitol as the start of the “next American Revolution.”

Jeremy Bertino, 43, testified at the trial of former Proud Boys leader Henry “Enrique” Tarrio and four other members of the organization that in the days leading up to the riot at the Capitol, the group increasingly believed they would have to take action to stop Trump’s defeat to Democrat Joe Biden.

Defense attorneys have contended that the group is little more than a glorified drinking club that had no actual plan to either storm the Capitol or prevent Biden from taking office. Miller’s testimony portrayed the group’s march through Washington on Jan. 6 as an organized and concerted advance toward the Capitol that pinpointed weaknesses in Capitol Police defenses and exploited them to help facilitate the breach of the Capitol.

With the latest revelations of the Jan 6 fiasco this 'trial' could also be suspect.

Federal prosecutors on Monday rested their seditious conspiracy case against former Proud Boys leader Enrique Tarrio and four lieutenants charged with plotting to stop the peaceful transfer of presidential power from Donald Trump to Joe Biden after the 2020 election.

Jurors will hear testimony by defense witnesses before they begin deliberating in one of the most serious cases to come out of the Justice Department’s massive investigation of the deadly Jan. 6, 2021, Capitol insurrection.

 

Judge in Proud Boys trial rejects claims of government misconduct​

Prosecutors did not withhold or “suppress” Jan. 6 security footage — aired in February by Tucker Carlson — from the Proud Boys now on trial for seditious conspiracy, a federal judge ruled late Sunday.

U.S. District Court Judge Tim Kelly used his 10-page order to knock down a series of thinly premised but eye-popping allegations lodged by one of those defendants, Dominic Pezzola, in recent weeks.

In fact, Kelly wrote, Pezzola’s lawyers have had access to most of the footage since September 2021 and the rest since early 2023, far enough in advance for Pezzola to use at trial. But Kelly also noted that there’s simply no indication that any of the footage is exculpatory for Pezzola, who helped ignite the breach of the Capitol building when he smashed a Senate-wing window with a stolen police riot shield.

WASHINGTON — A right-wing extremist who admitted he wielded a police shield and shattered a window at the Capitol during the Jan. 6 riot called the charges against him "fake" as the Proud Boys seditious conspiracy trial, which has been underway for more than three months, nears an end.

Dominic Pezzola — a Proud Boy from New York who is on trial along with former Proud Boys leader Enrique Tarrio, and three other members, Ethan Nordean, Joseph Biggs and Zachary Rehl — said during cross examination on Thursday that rioters on Jan. 6, 2021, were "acting as trespassing protesters." He also argued that law enforcement officers used excessive force on the mob that day.

WASHINGTON — Hours before jurors began deliberating the fate of five Proud Boys charged with seditious conspiracy in connection with the attack on the U.S. Capitol, the former head of the far-right organization said that federal prosecutors were unfairly using "locker room" talk against Jan. 6 defendants, echoing a defense used by Donald Trump during the 2016 presidential campaign.

WASHINGTON — Jurors deliberating the fate of five Proud Boys charged with seditious conspiracy in connection with the Jan. 6 attack on the U.S. Capitol appear to be struggling with the charges against at least some of the defendants.

The jury sent a note to U.S. District Judge Timothy Kelly Tuesday morning asking for additional instruction, asking what to do if they do not agree on all charges. “We did not receive instructions on what to do if the jury does not reach unanimity on a charge. How should we proceed in this scenario?” the note stated, in part.

Trump in power after his election defeat by leading a violent mob in attacking the Capitol on Jan. 6, 2021. The jurors in the case failed to reach a decision on the sedition charge for one of the defendants, Dominic Pezzola, although he was convicted of other serious felonies.

The verdicts, coming after seven days of deliberations in Federal District Court in Washington, were a major blow against one of the country’s most notorious far-right groups and another milestone in the Justice Department’s vast investigation of the Capitol attack.

With Thursday's criminal convictions of five Proud Boys, including leader Henry “Enrique” Tarrio, a third jury has stamped history’s judgment on January 6 as an organized, violent uprising meant to overturn the 2020 election. In courtrooms, it’s now established beyond a reasonable doubt that the Capitol siege was not spontaneous, but rather a planned assault by force on our democracy. Four defendants — Ethan Nordean, Joseph Biggs, Zachary Rehl and Tarrio — were found guilty of the top charge of seditious conspiracy. (The jury reached a partial verdict in the case, meaning it will continue deliberations on some remaining counts.)
